1. Introduction
This Participant Acknowledgement and Waiver (this “Agreement”) is made effective immediately by Total Family, Inc., a Delaware corporation (“TFI”), and the individual end user (“Participant”).
This Agreement is a condition of accessing services provided through a contract between TFI and the organization (e.g., employer or advisory firm) sponsoring Participant’s access.
2. Services
TFI provides consulting, coaching, and administrative services through a digital platform (the “Services”). These Services are not intended to constitute financial, legal, accounting, or medical advice. Users should consult with appropriate professionals for advice specific to their circumstances.
The Services may include interactive tools, summaries, and communications that support reflection and planning. No sensitive financial, legal, or medical data is collected, stored, or processed by TFI.
3. Waiver and Release
Participant voluntarily waives and releases TFI and its affiliates, officers, employees, and agents from all claims relating to any personal, psychological, or financial loss arising from use of the Services, excluding those caused by willful misconduct or as prohibited by law.
4. Indemnification
Participant agrees to indemnify and hold TFI harmless from any claims, losses, or expenses (including legal fees) resulting from misuse of the Services or breach of this Agreement, except where arising from TFI’s fraud or willful misconduct.
5. Confidentiality
“Confidential Information” includes any non-public, proprietary, or personal information shared with or accessed by TFI through the platform. TFI will not share this data, except as required to deliver the Services, or as required by law or court order.
TFI adheres to strict confidentiality practices but is not responsible for risks associated with internet-based communication platforms. Participant consents to reasonable use of virtual tools, understanding inherent confidentiality limitations.
6. Disclosures and Consent
Some Services may include therapeutic-style exercises or summaries. TFI does not offer clinical therapy or mental health treatment. By using the Services, Participant acknowledges this distinction and consents to any in-app note summarization or video recordings (when disclosed and agreed to).
7. Access Through Sponsors
If Participant’s access is paid for by an advisor, firm, or employer, TFI may share limited anonymized usage data with that sponsor. If the sponsor terminates the relationship, Participant will be offered a discounted individual membership to continue access.
8. Termination
TFI reserves the right to suspend or terminate Participant’s access at its sole discretion in cases of misuse, abuse, or violation of these Terms. Participants may also cancel their access at any time.
9. Dispute Resolution & Jurisdiction
Any disputes arising from this Agreement will be resolved via binding arbitration in Delaware. Class actions and jury trials are waived. This Agreement is governed by the laws of the State of Delaware, without regard to conflict of law principles.
10. Changes to These Terms
TFI may modify these Terms at any time. Continued use of the Services after logging in will constitute acceptance of any updates.

If your account is sponsored by an advisor or employer, we may share anonymized or aggregated usage data with them. They do not have access to your personal notes or identifiable activity unless explicitly authorized.
If a sponsor terminates your access, you may continue using the platform with an individual membership, including a discounted offering.
5. Third-Party Tools We Use
We rely on trusted service providers to operate the platform:
Stripe for secure payments (Stripe Privacy)
Google for login and calendar integrations (Google Privacy)
OpenAI to generate summaries of coaching notes (no PII is sent; OpenAI API Use)
Daily.co for video conferencing (Daily.co Privacy)
Use of these services is subject to their respective privacy policies. We do not store payment data.
6. Security Practices
We protect your data through:
Encryption of data in transit and at rest
Hosting on secure AWS servers
Two-factor authentication for employees
Staff confidentiality agreements and regular training
7. Your Rights and Choices
You may:
Access or update your personal data through your account
Request account deletion by emailing hello@totalfamily.io
We honor deletion requests promptly and securely.
8. Cookies & Tracking
We use only essential cookies for authentication and session management.
We do not use cookies for advertising or analytics.
9. No Use by Minors
Our platform is intended for users 18 years or older. We do not knowingly collect information from children under 18 and prohibit minors from using the service.

TFI complies with applicable privacy regulations, including:
